Mold is naturally occurring and may cause health risks or damage to property. To reproduce, molds produce tiny spores that waft through the indoor and outdoor air continually. When mold spores land on a damp spot indoors, they may begin growing and digesting whatever they are growing on in order to survive. There are molds that can grow on wood, paper, carpet, and foods. When excessive moisture or water accumulates indoors, mold growth will often occur, particularly if the moisture problem remains undiscovered or un-addressed. There is no practical way to eliminate all mold and mold spores in the indoor environment; the way to control indoor mold growth is to control moisture.

In general, REALTORS are not qualified to inspect for, detect the presence of, advise customers or clients about, or remediate mold. Always consult with an environmental professional when dealing with mold issues.

Buyers have a right to inspect for mold before purchasing a property. The FAR-BAR "AS-IS" Residential Contract for Sale and Purchase contains the following language in Section 10. Disclosures:

(c) MOLD: Mold is naturally occurring and may cause health risks or damage to property. If Buyer is concerned or desires additional information regarding mold, Buyer should contact an appropriate professional.

The Florida REALTORS Contract for Residential Sale and Purchase (CRSP) uses an addendum to address the issue:

R. Mold Inspection:
1
.   Mold Inspection: Buyer may, at Buyer’s expense, have a home inspector, licensed contractor, or other licensed professional (if required by law) conduct an inspection of the Property for the presence of mold within ____ days (20 days if left blank) after Effective Date (“Mold Inspection Period”). Buyer will repair all damage to the Property resulting  from  the inspection  and restore  the  Property to  its  pre-inspection  condition;  this obligation will survive termination of this Contract.
2.   Cancellation: If the inspection reveals the presence of mold that requires professional remediation to remove at acost that exceeds $                                      ($500 if left blank), Buyer may cancel this Contract by delivering written notice to Seller within 3 days after expiration of the Mold Inspection Period; and Buyer’s deposit(s) will be refunded. If Buyer fails to timely conduct the inspection or fails to timely deliver notice of Buyer’s cancellation, this contigency will be waived; and Buyer will continue with this Contract.
